Terms of Use

1. General provisions

Bassario is an online service for listings and communication between users. These Terms govern the use of the bassario.com website, the mobile apps, the API and related functions: search, publication of listings, the map, favourites, chat, support and moderation. By using the service or creating an account, the user accepts these Terms and the related Bassario documents.

2. Related documents

The relationship with the user is also governed by the documents published in the Legal documents section. Where special rules exist for a particular function, they apply together with these Terms.

3. Account and registration

An account is required to publish listings and to use chat, favourites and certain other functions. The user undertakes to provide current information, not to create accounts in order to circumvent restrictions, not to give access to third parties and to report any suspected unauthorised access without delay. Actions performed after signing in to an account are deemed to have been performed by the user unless proven otherwise. Bassario may request confirmation of a phone number by SMS for individual functions of the service. Confirmation of a phone number is not a full verification of the user's identity and does not guarantee the seller's good faith, the quality of the goods or service, or the safety of the transaction. Creating an account constitutes acceptance of these Terms, the User Agreement and the Privacy Policy in the version in force on the date the account is created. Links to those documents are shown next to the account creation form — before the account is created and for all registration methods, including signing in with Google and Apple; creating an account constitutes their acceptance. The date the account was created is recorded in the system. If the user does not agree with those documents, creating an account and using the functions that require authentication is not possible.

4. Age and legal capacity

The service is intended for persons over 18 years of age. By using Bassario, the user confirms that they have the right to enter into transactions, publish listings and accept these Terms. A representative of a company, an agency or an owner confirms that they hold the necessary authority.

5. Listings

The user is responsible for the legality, accuracy and currency of the listing, the photos, the price, the address, the characteristics and the contact details. A listing must relate to a real product, service or item and must not mislead other users. Detailed requirements are set out in the Listing Rules.

6. Transactions between users

Bassario provides a technical platform for posting listings and communicating. Bassario is not a seller, buyer, landlord, tenant, agent, broker, payment intermediary or a party to transactions between users, unless expressly stated otherwise. Users independently verify documents, authority, the condition of the item and the terms of payment and handover.

7. Chat and communications

Chat is intended for discussing listings and the terms of a transaction. A user may send text messages and attach photos, videos, audio recordings, voice messages and files to them. Spam, threats, insults, fraud, phishing, distribution of malicious links and files, attempts to circumvent the rules, publication of third parties' personal data, and sending materials that infringe the rights of third parties or that are prohibited from being posted are all prohibited. The Operator may analyse messages, attachments and complaints for the purposes of security and moderation in the manner described in the Privacy Policy.

• by sending an attachment, the user confirms that they hold the necessary rights to it and that its transfer does not infringe the rights of third parties or the requirements of applicable law
• the user is responsible for the content of the messages and attachments they send; the Operator is not the sender and does not control the content of correspondence at the moment of sending
• the Operator may limit the size and type of attachments sent and block the sending of files that pose a security threat
• messages and attachments are not intended for transferring information requiring a special protection regime (including payment details, passwords and confirmation codes); the Operator does not request such information in correspondence
• the function of saving an attachment to a device is provided for the recipient's personal use; any further distribution of the received materials is carried out by the user at their own responsibility

8. Moderation and restrictions

Bassario may review listings, photos, messages and accounts automatically or manually. In the event of a breach of the rules, Bassario may reject a listing, hide it from search, delete content, restrict functions, temporarily block an account or terminate access. 9. Prohibited use

The user is prohibited from using the service for unlawful activity, posting prohibited goods and services, fraud, mass spam, scraping data, circumventing restrictions, infringing the rights of third parties, interfering with the operation of the service or attempting to gain unauthorised access to data.

10. Paid services

As at the date of these Terms, posting listings on Bassario is free. If paid features, promotion, subscriptions or commissions are introduced, Bassario will publish the terms, prices, payment procedure and refund rules in advance on the Refund policy page.

11. Intellectual property

The Bassario name, design, interfaces, texts, program code and brand elements belong to Bassario or are used on a lawful basis. By publishing a listing, the user grants Bassario a non-exclusive right to store, process, technically change the format of, display, promote and distribute the listing content as part of the operation of the service, the apps, the website, search results and link previews.

12. Service availability

Bassario seeks to keep the website and the apps running reliably but does not guarantee uninterrupted availability, the absence of errors or compatibility with all devices. The service may be temporarily restricted because of updates, maintenance, infrastructure failures, the actions of contractors or circumstances beyond Bassario's control.

13. Liability

Bassario does not guarantee the accuracy of listings and is not responsible for the actions of users, the quality of goods and services, the legality of a transaction, payments between users, the condition of items or losses arising from arrangements made by users on their own. The limitation of liability does not apply where the law expressly prohibits such a limitation.

14. Change and termination of access

A user may stop using the service and delete their account. Bassario may restrict or terminate access in the event of a breach of the Terms, the law or the rights of third parties, suspected fraud, a security threat or an inability to continue providing the service.

15. Changes to the terms

Bassario may update the Terms and the related documents. The date of the last update is stated at the top of the page. Material changes may be communicated to users through the website, the app or by email. Continued use of the service after an update constitutes acceptance of the updated terms.

16. Disputes and enquiries

Disputes and questions about the service should first be sent to support at support@bassario.com. The parties will seek to resolve a dispute through negotiation. If no agreement is reached, the dispute is dealt with under the law of Georgia. This does not deprive a consumer of the protection afforded by the mandatory rules of the country of their habitual residence.
